Which is the real MQM?
This case is divided into two parts, first is whether the real beneficiary is MQM Pakistan or MQM London. In simple words, which is the real and legal MQM that has been functioning since its inception?
During the hearing, MQM Pakistan provided a trail of documents in the form of constitution which were registered with the Election Commission of Pakistan (ECP). The only constitution that was not part of the EC record was the 2015 constitution relied upon by the defendants including Altaf Hussain.
The verdict shows that ICC Judge Jones accepted the case presented by MQM Pakistan and did not believe the case presented by Altaf Hussain’s legal team.
According to the judgement, the defendants contended that the 2015 constitution was an operational constitution that empowered Altaf Hussain under Article 9B of the 2015 constitution but failed to prove its originality. The judge accepted Altaf Hussain’s argument that he had approved a constitution on October 22, 2015 that contained several errors.
